These Terms of Service ("Terms") govern your access to and use of the Gleam platform and website operated by Gleam (BD SE App) ("Gleam", "we", "our", "us"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. The Service
Gleam provides a mobile-first CRM and job management platform for sole traders and small service businesses in the UK. The Service includes the Gleam mobile application, web application, and associated websites (collectively, "the Service"). We reserve the right to modify, suspend, or discontinue the Service at any time, with reasonable notice where possible.
2. Eligibility
You must be at least 18 years old and be using the Service for legitimate business purposes to create an account. By registering, you confirm that the information you provide is accurate and that you have the authority to enter into these Terms.
3. Account registration and security
You are responsible for:
- Maintaining the confidentiality of your login credentials
- All activity that occurs under your account
- Notifying us immediately of any unauthorised access at contact-us@gleam-jobflow.co.uk
We recommend using a strong, unique password and enabling two-factor authentication when available.
4. Subscription and payment
Gleam offers a free Starter plan and paid subscription plans (Pro, Business). Paid plans are billed monthly or annually as selected at sign-up. Prices are confirmed at launch and displayed clearly before you commit to any payment. We reserve the right to change pricing with 30 days' notice to existing subscribers. Payment is processed by a third-party payment processor. By subscribing, you authorise us to charge your payment method on a recurring basis.
5. Free plan
The Starter plan is free and subject to the limits described on our Pricing page. We reserve the right to modify the features and limits of the free plan with reasonable notice. The free plan does not include SLA guarantees or priority support.
6. Cancellation and refunds
You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of your current billing period — you retain access until then. We do not offer pro-rata refunds for mid-period cancellations, except where required by law. If you believe you've been charged in error, contact us within 14 days and we'll investigate.
7. Your content
Any data, information, or content you upload to Gleam ("Your Content") remains yours. You grant us a limited, non-exclusive licence to store and process Your Content solely to provide the Service. We do not claim ownership of Your Content and will not use it for purposes beyond operating the Service.
8. Acceptable use
You agree not to use the Service to:
- Violate any applicable law or regulation
- Infringe intellectual property rights
- Upload malicious code, spam, or unauthorised advertising
- Attempt to gain unauthorised access to Gleam's systems or other users' accounts
- Resell or sublicense the Service without our written permission
We reserve the right to suspend or terminate accounts that breach these terms.
9. Intellectual property
Gleam and its logo, design, software, and content (excluding Your Content) are owned by Gleam (BD SE App) and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or distribute our intellectual property without our explicit written consent.
10. Disclaimer of warranties
The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or completely secure. We will use reasonable commercial efforts to maintain uptime but do not provide an SLA on Starter plans.
11. Limitation of liability
To the maximum extent permitted by law, Gleam shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability to you in any 12-month period shall not exceed the total subscription fees paid by you to Gleam during that period. Nothing in these Terms limits liability for death, personal injury caused by negligence, or fraud.
12. Indemnity
You agree to indemnify and hold harmless Gleam, its directors, employees, and contractors from any claims, losses, or expenses (including legal fees) arising from your breach of these Terms or your use of the Service.
13. Termination
Either party may terminate the agreement at any time. We may terminate or suspend your account immediately, without notice, if you breach these Terms. On termination, your right to access the Service ceases. Data export is available for 30 days following account closure; after that, data is permanently deleted.
14. Governing law
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
15. Changes to these Terms
We may update these Terms from time to time. We'll notify you by email and update the "last updated" date at the top of this page. Continued use of the Service after changes constitutes acceptance. If you do not agree with the updated terms, you may close your account.
